HABITAT CAPE COD RIDE FOR HOMES WAIVER AND RELEASE OF LIABILITY

READ BEFORE SIGNING

In consideration of being allowed to participate in the Habitat Cape Cod Ride for Homes (the Event) I hereby acknowledge and agree that:

1. The risk of injury from the activities involved in this Event is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury and property damage remains.

2. I have read the Habitat for Humanity of Cape Cod Ride for Homes Safety Plan and agree to its terms.

3. I knowingly and freely assume all such risks, both known and unknown, even those arising from the negligence of the Releasees named below, or any of them, and I assume full responsibility for my participation; and

4. II, for myself and on behalf of my heirs, executors, assigns, representatives, and Minor Participants, hereby release Habitat for Humanity of Cape Cod and SAG Wagon, and each of their respective affiliates, as well as each of the aforementioneds? officers, directors, officials, agents, employees, volunteers, sponsoring agencies, sponsors, and advertisers (collectively the ?Releasees?), to the fullest extent permitted by law, from and against any liabilities, causes of action, injuries, disability, death, loss of income, damage to or loss of property, pain and suffering, and/or all damages of any kind whatsoever, whether compensatory, statutory, or punitive (collectively, the ?Claims?) arising out of or related in any to the Event. This release includes all Claims arising out of or related to the negligence of the Releasees.

5. I hereby consent to emergency medical treatment in the event of my injury during the Event.

6. I agree to always wear an appropriate bicycle helmet while participating in the Event.

7. I agree to comply with all statutes, rules and regulations governing the operation of bicycles on public roads and bicycle paths and all other rules of the Event.

8. I grant full permission for the use of my likeness in all media including photographs, video recordings and any other record of the Event for any legitimate purpose.

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

FOR PARTICIPANTS OF MINORITY AGE(UNDER AGE 18 AT THE TIME OF REGISTRATION)

This is to certify that I am the parent or guardian with legal responsibility for this participant (Minor Participant). I hereby consent and agree to the terms of this Waiver and Release of Liability as provided above on behalf of the Minor Participant. I further agree to release, and indemnify and hold harmless the Releasees from all Claims liabilities arising out of or related in any way to the Minor Participant?s involvement or participation in the Event to the fullest extent permitted by law. I have discussed with the Minor Participant each of the terms and requirements set forth in this Waiver and Release of Liability. I understand that an adult must always accompany the Minor Participant during the Event that such adult shall be responsible for supervision of the Minor Participant.
