Release of Liability & Waiver of Legal Rights

Risk of Activities. The undersigned agrees, understands and acknowledges that participating in activities in connection with the Tanner Foundation Grace Ragland 450, September 27-October 1, 2023 (the “Event”) involves strenuous physical exertion for an extended period of time (the "Activities") that can be HAZARDOUS AND INVOLVES THE RISK OF PHYSICAL INJURY AND/OR DEATH AND/OR PROPERTY LOSS. The undersigned acknowledges that the Activities are inherently dangerous and fully realizes the dangers and risks of participating in the Activities. The risks include, but are not limited to, extreme physical demands and exertion, exhaustion, lack of instruction, negligence of instruction and/or other participants at the Event, lack of or delay in receiving medical attention, defects or dangerous conditions of property, equipment or facilities at which, or roadways, sidewalks, paths, and other surfaces over which, the Event is held, temperature, weather, equipment, actions of other people including, but not limited to, participants, volunteers, spectators, Event officials, and event monitors, and/or producers of the Event. The foregoing risks and dangers are not only inherent to participants but are also present for volunteers. The undersigned hereby assumes all the risks of participating and/or volunteering in connection with the Event and the Activities, including without limitation those risks set forth above.

Release, Indemnification and Assumption of Risk. In consideration of the undersigned being permitted to participate and/or volunteer in the Event and the Activities, the undersigned agrees as follows:

(a) Release. THE UNDERSIGNED HEREBY IRREVOCABLY AND UNCONDITIONALLY RELEASES, FOREVER DISCHARGES, AND AGREES NOT TO SUE OR BRING ANY OTHER LEGAL ACTION AGAINST THE RELEASED PARTIES (AS DEFINED BELOW) with respect to any and all claims and causes of action of any nature whether currently known or unknown, which the undersigned has or may in the future have and which could be asserted by or on behalf of the undersigned in connection with the undersigned's involvement as a participant and/or volunteer in the Event and the Activities, including, but not limited to, claims of negligence, negligence per se, negligent misrepresentation, premises liability, tort claims, breach of warranty, statutory violations and breach of contract. For purposes of this Release, the term "Released Parties" shall mean the Tanner Foundation, and their respective officers, directors, managers, employees, agents, representatives, members, volunteers, assigns and successors in interest, event holders, event sponsors, and event directors.

(b) Indemnification. The undersigned hereby agrees to indemnify, defend and hold harmless the Released Parties from and against any and all liabilities, damages, costs, losses, medical bills, expenses, costs, attorneys' fees, and all other liabilities or damages of any kind or nature whatsoever, arising out of or related to or the result of the undersigned's involvement as a participant or volunteer in the Event and the Activities. The foregoing indemnification obligation on the part of the undersigned shall survive the period of the undersigned's involvement as a participant of volunteer in the Event and the Activities.

(c) Assumption of Risk. The undersigned agrees and understands that there are dangers and risks associated with participating and/or volunteering in the Event and Activities and that INJURIES AND/OR DEATH may result from participating and/or volunteering in the Event and Activities, including, but not limited to, the acts, omissions, representations, errors, carelessness and negligence of the Released Parties. The undersigned acknowledges that participation in the Event and Activities is voluntary. The undersigned also acknowledges that he/she is physically and mentally capable of participating and/or volunteering in the Event and Activities. RECOGNIZING THE RISKS AND DANGERS, THE UNDERSIGNED UNDERSTANDS THE NATURE OF THE EVENT AND ACTIVITIES AND VOLUNTARILY CHOOSES FOR THE UNDERSIGNED TO PARTICIPATE IN AND EXPRESSLY ASSUMES ALL RISKS AND DANGERS OF THE PARTICIPATION IN THE EVENT AND ACTIVITIES, WHETHER OR NOT DESCRIBED ABOVE, KNOWN OR UNKNOWN, INHERENT, OR OTHERWISE.

Medical Care. The undersigned authorizes the Released Parties and/or their authorized personnel to call for medical care for the undersigned and/or to transport the undersigned to a medical facility or hospital if, in the opinion of such personnel, medical attention is needed. The undersigned hereby consents to receive medical treatment from first responders and/or from medical personnel at a medical facility or hospital to which the undersigned is transported in the event of injury, accident and/or illness occurring in connection with the undersigned's involvement as a participant and/or volunteer in the Event and Activities.

The undersigned hereby certifies that he/she is physically and mentally capable of participating and/or volunteering in the Event and Activities, has no known medical conditions that could affect his/her capabilities of participating and/or volunteering in these Activities and have not been advised otherwise by a qualified medical person. I understand that at this event or related activities, I may be photographed, videoed, filmed, or otherwise recorded. I agree to allow my photo, video or film, or otherwise recorded likeness to be used for any legitimate purpose by the Event holders, producers, sponsors, organizers and/or assigns without compensation or notice to me, and I waive and release any and all claims I may have with respect to any such use of any such photo, video, film, or other recording.

This Release of Liability and Waiver of Legal Rights shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I hereby certify that I have read this document, and I understand its content. I further certify that I am nineteen (19) years old or older.
